Are Fairfax County Foreclosures and Short-Sales Disappearing?

typetransaction2012The market in Fairfax County Virginia is doing great in 2012. The number of transactions are down slightly for 2012 keeping inventory low in most areas. The prices have held up well and increased some in many areas thanks to low interest rates and good employment opportunities.

A lot of the attention in real estate has been towards distressed sales the last few years. While foreclosures and short-sales never really ruined the market in Fairfax County, some local areas did see values decimated by distressed sales after the 2006 real estate crash.

The worst seem to be behind us in Fairfax County. In 2009 a whole 34% of sales in Fairfax County were distressed. The percentage has decreased ever since and this year it seems that we may end up with a proportion of distressed sales at half that (about 17%.)

More regular sales, strong labor market and low inventory would normally mean rising prices. While prices are inching upwards in many places, reluctant and conservative appraisers are keeping a lid on rapid appreciation in many communities. Some will say that is a good thing after what happened during the boom years.

Ash Grove Historic Site and park in Tysons Corner

Ash Grove in Tysons Corner Virginia - SoldsenseAfter writing about the old graveyard on Colonel Lindsay’s old estate in the Idylwood area I thought of another interesting local site in Tysons Corner. That is the 12.3 acre Ash Grove historic Site in Tysons Corner.

The original home on Ash Grove was built about 1790 by Bryan Fairfax for his son Thomas Fairfax (the Ninth Lord Fairfax.) The original site was 5000 acres that, in addition to the manor house, had a farm and a manor house. Ash Grove was sold to the Sherman family shortly before the civil war and remained with them until the 1960′s. The manor burned down in the 60′s and was rebuilt.

Ash Grove was dedicated to the Fairfax County Park Authority in 1997 as part of the development of Tyson’s Village. The historic main house and outbuildings are located out of the floodplain while the majority of the property is in the floodplain along Old Courthouse Spring Branch Stream Valley. today a park.  The structures are not currently open to the public but there are plans to open it for special events in the future.

Ash Grove is located off Rt 7 behind the new Walmart being built at the Tysons West site and the new silver line metro has added a stop nearby. It is bordered by a condominium and townhome community called Westwood Village.

Walmart Opening in Tysons Corner Soon

As we wrote about last year, Walmart is coming to Tysons West in 2013. It is next to the new metro stop on the Silver Line through Tysons Corner. There is no exact date for the opening of the Walmart -  deliveries for office locations have been indicated to be early 2013 so hopefully by the summer.

The urban style Walmart will be about 78,000 sq/ft.  For comparison – the new “urban style” Target in Merrifield is about 163,000 square feet.  So, this new Walmart is half the size of that Target – not a monstrosity by any measure.

The Walmart is part of Phase 1 of the Tysons West development. The area between the Walmart and Rt-7 has been scheduled to be developed as well as part of a Phase 2/3 development.

Developments that will benefit from this development include Fountains at McLean, Rotonda and Westwood Village. All are great communities – please contact us if you would like more information on any of those.

Don’t Wait For Spring To Sell Your Home!

2013HomesComingOnMarketThe Tysons Corner(Vienna and McLean) real estate market ended 2012 strongly. While the number of homes being listed remained typical, the number of sales in October and November jumped significantly. The continued availability of low interest rate loans no doubt played a role as did the strong economy in the area.

Looking at the graphs it is obvious that sellers in Tysons Corner prefer to put their homes on the market in March and April. Purchasers seems to feast on those listings and do their closings during the summer.

In general we advice to buy and sell when you are ready. That being said, many will try to use the market trends to their benefit. So, here are some thoughts on using the trends to your advantage.

2013NumSalesAs a seller, to avoid the March-April rush you could try listing your home in January or February. That way you may take advantage of any pent-up demand from the winter months. Currently homes (and condominiums in particular) in Tysons Corner are selling very well – multiple offers are not uncommon. The main thing holding prices at the current levels would be the conservative  appraisals.

Alternatively you could try listing in May. Your new listing will look attractive with few days on the market as compared to homes having been listed in March and April. You may also take advantage of the high number of closing sales in the June-August time frame.

If you have a choice – when should you purchase a home? You could try to get an early start on the large inventory being listed in March and April instead of joining the crowd purchasing in May-July.

Land Restrictions and Fairfax County Resource Protect Areas

This stream in Pimmit Hills is often dryIf you are planning to buy or renovate a home, a Resource Protect Area (RPA) may be something that will impact you and the value of your home significantly A Resource Protection Area is created to limit development around water bodies with perennial flows. The goal is to improve the health of the Chesapeake Bay and its tributaries through limited development.

The Chesapeake Bay Act has been around for a while and most purchasers do know that development potential is limited around streams, lakes and rivers in Fairfax County. However, in 2003, the regulations were amended and further restrictions were put in place. The definition of what was covered under the act was changed from “tributary streams” to ”water bodies with perennial flow”. The result was that a large number of new areas and homes were affected – often reaching deep into exisiting subdivisons and alongside what most would have considered “storm drains” up to that point.

The most obvious impact on homeowners are limitations on the use of a property and a resulting loss of value. If you are in a RPA, you are subject to restrictions on decks, sheds, fences, extensions on your home and many landscaping projects. 

For example, if your home is in an RPA and you want to build an extension to your home in Fairfax County :

For those lots that have areas of RPA on them, the ordinance provides relief from the full effects of the RPA restrictions through the administrative waiver provisions. The provisions allow minor additions of up to 1,000 sq. ft. or 2 percent of the lot area up to a maximum of 2,500 sq. ft. of new impervious area in the RPA for homes constructed prior to the original effective date of the ordinance, July 1, 1993, with respect to both the old and new RPA areas. For homes that were constructed between July 1, 1993, and the effective date of the 2003 amendments, Nov. 18, 2003, minor additions are only allowed to encroach into the new RPA areas created by the amendments. This relief is provided to the current owners of these homes because the regulations were not in effect at the time the homes were built and the original builders did not have the opportunity to plan the location of these homes to avoid future conflicts with the RPA.

The state regulations on which the county’s ordinance is based do not permit detached structures to be treated as minor additions. The construction of detached structures and larger additions in the RPA are still possible, but would be subject to an exception process requiring a public hearing.

From the above, determining when a home is built and if that home is in an RPA is very important. One tool to do that would be to use the online Digital Map Viewer for Fairfax County – you select the “Chesapeake Bay Map” and then pick the Tax Map number for your property. You can find the tax map number by looking at the two first numbers of the tax-id for the property in the county tax records. With the correct map you will have to zoom in to find your property and determine if it is in one of the RPAs, if it is then 1993 or the 2003 RPAs and what effect that has on the specific property (see the excerpt above for the difference between being in the 1993 and 2003 RPAs.)

Purchasing a home next to a small stream is the dream of many. Before you purchase, make sure you know what the impact, if any, the RPAs has on specific property. You will then be able to make an informed decision.

Homes For Sale Near the Bike Trail in Falls Church and Arlington

bikepath2The extensive network of bike paths in the Northern Virginia area is a gift many appreciates. Paths like the Washington and Old Dominion Trail(W&OD), Custis Trail and Mount Vernon trail are all very popular with bikers, runners, walkers and rollerbladers of  all ages. 

On a typical morning the trails will be full of residents doing their morning jog and commuters using the trails to get in from the suburbs to work in areas like Tysons Corner, Arlington and Washington DC. On the weekend large groups of bikers and joggers will take over the trail interspersed with families out for some family fun.

Merrifield Mosaic District Opening Soon!

2012-06-08_08-13-57_182The Mosaic District in Merrifield is nearing completion and finishing touches are taking place on streets and buildings throughout the urban community. The Angelika theatre will open in September, Target in October and by Christmas most/all of the remaining stores and restaurants will be open.

Mosaic will also house Mom’s Organic Market, Hotel Sierra, Black’s Bar and Kitchen, matchbox, Taylor Gourmet, a bakery, a butcher and other boutique style shops.  The Eya townhomes are for sale in the $600,000 range and upwards. The new development has more than  100 new town homes built by Eya.

2012-06-08_08-10-27_575Contrary to media reports, I would dare to propose that the construction at the  Rt 29/Gallows Road intersection is incomplete. Construction is still going on and they also seem to have quite a bit of work left on Gallows from Merrifield Garden center and up towards Wilton House and the Merrifield/Dunn Loring metro station.

The Angelika theatre is hosting some “shorts” for the DC Shorts Film Festival 9/14-9/16.

tysons corner market activityBased on the first seven months of 2012 the Tysons Corner (Vienna and McLean) market will remain strong. The 2012 spring and summer market has followed the trends of 2011 with about the same amount of homes coming on the market. July did see less activity so it will be exciting to see what August will bring. 

The number of closings are up some but overall I expect this year to be the same as last year. For the rest of the summer we’ll probably be at about 65 homes a month selling before things start to slow down again.

What To Do About Dangerous Trees

After the severe thunderstorm that took place in July there has been concerns from many homeowners regarding their own and the trees of their neighbors. The storm caused a number of trees to fall completely and also left others in a damaged and potentially hazardous state.

If the tree is on public/county land, contact the following agencies:

  • Near public streets and roads: Call VDOT at 1-800-FOR-ROAD (367-7623), TTY 711
  • Fairfax County Parks: Call the Park Authority’s Operations Division at 703-324-8594, TTY 711
  • Northern Virginia Regional Parks: Call the Northern Virginia Regional Park Authority at 703-352-5900, TTY 711.
  • Stormwater management ponds: Call the Maintenance and Stormwater Management Division at 703-877-2800, TTY 711
  • Public school property: Call the Fairfax County Public Schools at 571-423-2350, TTY 711.

If the tree is on private property, the property owner is responsible for maintaining their trees. Fairfax County has no authority to force a tree removal on private property unless it is  a public hazard. See our article from last year called “My Neighbor’s Tree is Ruining My Driveway“.

In general a homeowner can remove a tree on their property as they wish. However, conservation easements are common in Northern Virginia (may also be called things like  Resource Protection Area – RPA, or an Environmental Quality Corridor.)  See our article called “What RPA means and why you should care.

If the tree is in a conservation easement, you will need contact the Urban Forest Management Division at 703-324-1770 for them to come by and take a look before you do anything.
